TERMS & CONDITIONS

1. Scope of Application

These Terms apply to all business conducted through the MEDOME website.

We sell to:

• Business customers (B2B)
• Private consumers (B2C)

Business customers are those acting within their professional or commercial activity.

2. Request-Based Ordering System

The MEDOME website does not provide automatic online purchasing.

Product prices displayed on the website are indicative only and do not constitute a binding offer.

By clicking “Inquire about this product”, the customer submits a non-binding request.

A binding sales contract is concluded only when:

• MEDOME d.o.o. issues a written quotation or invoice specifying agreed terms, and
• The customer confirms acceptance by making full payment.

MEDOME d.o.o. reserves the right to adjust pricing based on quantity, specifications, materials, delivery location, or other commercial factors.

3. User Accounts

To submit inquiries, customers may be required to create an account.

Users are responsible for maintaining the confidentiality of their login credentials.

MEDOME d.o.o. reserves the right to suspend or delete accounts at its discretion.

SECTION A – BUSINESS CUSTOMERS (B2B)

4. Payment

Payment is made exclusively via bank transfer unless otherwise agreed in writing.

Full payment is required before production or shipment unless explicitly agreed otherwise.

5. Retention of Title

Ownership of the goods remains with MEDOME d.o.o. until full payment has been received.

Until ownership transfers, the buyer may not resell, pledge, or use the goods as security without written consent.

6. Transfer of Risk

Risk transfers to the buyer upon handover of goods to the carrier.

MEDOME d.o.o. is not liable for delays caused by logistics providers, customs authorities, or other third parties.

7. Inspection and Claims (B2B)

Business customers must inspect goods immediately upon receipt.

Visible defects must be reported in writing within 7 days.

Failure to report within this period results in exclusion of warranty claims.

8. Warranty (B2B)

Warranty covers manufacturing defects only.

We are not liable for:

• Improper installation
• Misuse
• Unauthorized modifications
• Normal wear and tear
• Environmental or external damage

SECTION B – PRIVATE CONSUMERS (B2C – EU)

9. Right of Withdrawal

EU consumers have the right to withdraw within 14 days of receiving goods.

However, the right of withdrawal does NOT apply to:

• Custom-made products
• Products manufactured according to customer specifications
• Products negotiated and individually configured
• Used, installed, or modified goods

Returned items must be unused and in original packaging.

Return shipping costs are borne by the customer unless otherwise required by law.

10. Consumer Warranty

Statutory EU consumer protection rights apply.

Warranty covers manufacturing defects existing at the time of delivery.

GENERAL PROVISIONS

11. Custom Production

Most MEDOME products are manufactured based on customer-specific requirements including quantity, wood type, configuration, and delivery conditions.

Once production has begun, orders are binding and non-refundable.

12. Limitation of Liability

MEDOME d.o.o. guarantees product quality at the time of delivery and proper shipment.

Total liability shall in any case not exceed the value of the purchased goods.

We are not liable for:

• Indirect damages
• Loss of production
• Loss of profits
• Business interruption
• Consequential or economic damages

Nothing in these Terms excludes liability where exclusion is not permitted by applicable law.

13. Force Majeure

MEDOME d.o.o. shall not be liable for delays or failure to perform obligations due to events beyond our reasonable control, including but not limited to:

• Natural disasters
• War
• Government actions
• Customs delays
• Supply chain disruptions
• Strikes
• Transportation failures

14. Intellectual Property

All product designs, images, texts, trademarks, and website content remain the intellectual property of MEDOME d.o.o.

Any reproduction, distribution, or commercial use without prior written consent is strictly prohibited.

15. Changes to Terms & Conditions

MEDOME d.o.o. reserves the right to modify or update these Terms & Conditions at any time without prior notice.

The version published on our website at the time of invoice issuance shall apply.

16. Governing Law

These Terms shall be governed by the laws of Bosnia and Herzegovina.

For EU consumers, mandatory consumer protection laws of the consumer’s country remain unaffected.

17. Dispute Resolution

The European Commission provides an online dispute resolution platform (ODR):

We are not obliged to participate in consumer arbitration proceedings.
